JUSTICE SANJAY PRIYA ORAL ORDER 28-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Naugachia Rail P.S. Case No. 28 of 2016 instituted for the offence under Section 379 of the Indian Penal Code.

While the informant was traveling from Varanasi to Gowahati by train No. 15623, theft had been committed of her purse which contained Mobile, Golden Chain, ATM Card, etc. The thief was apprehended and he disclosed his name as Ranjit Kumar. The name of this petitioner has come during the course of investigation on the ground that one of the Mobile Phone was recovered from his possession.

It has been submitted on behalf of the petitioner that

No.13032 of 2017 (3) dt.28-04-2017 2/2 the main accused Ranjit Kumar has already been granted bail by a co-ordinate Bench of this Court by order dated 22.02.2017 passed in Cr. Misc. No. 6554 of 2017. This petitioner was the sixth user of the aforesaid mobile phone. He had no knowledge that the aforesaid mobile was stolen one.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Khagaria in connection with Naugachia Rail P.S. Case No. 28 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
