JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This application, for grant of anticipatory bail, arises out of Agamkuan P.S. Case No. 380 of 2018, disclosing offences under Sections 419, 420, 467, 468, 471, 379/34 of the Indian Penal Code.

Allegation as per the F.I.R. is that when the informant was on petrolling duty, he found a scorpio vehicle parked and five to six persons sitting in the said vehicle and on seeing the police, they started fleeing away, however, on chase two of them were apprehended, who disclosed the names of petitioner and their other associates and on search several A.T.M. cards, cash and they further disclosed that they were engaged in duping the people by calling them on phone and alluring them to deposit money to win prize.

Submission of learned counsel for the petitioner is

Patna High Court Cr.Misc. No.10323 of 2019(2) dt.20-02-2019 2/2 that he has made accused in this case only on the basis of confessional statement of the co-accused, who were apprehended on the spot and except that there is nothing against the petitioner. Further submission is that the co-accused, whose name has also come on confession of the apprehended person, has already been granted the privilege of anticipatory bail vide order dated 11.02.2019 passed in Cr. Miscellaneous No. 6984 of 2019.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, in connection with Agamkuan P.S. Case No. 380 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
