2. This application, for grant of anticipatory bail, arises out of Amarpur Police Station Case No. 629 of 2024, corresponding to G.R. No. 3059 of 2024, disclosing offences under Sections 126(2), 115(2), 74, 110, 303(2), 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita (B.N.S.), 2023.
3. The prosecution case, as per the First Information Report, is that on 08.09.2024, the petitioners were abusing the informant and when protested, the petitioner no. 1 assaulted the informant by fist and rod on her head and petitioner no. 2 tore the cloth of the informant.

4. Learned Counsel for the petitioners submits that both the parties are co-villagers and the minor scuffle had taken place between both the them. A counter case has been lodged by the side of the petitioners bearing Amarpur P.S. Case No. 622 of 2024 against the informant and others which is prior in time. Referring to the impugned order, learned counsel submits that though the injury caused to the victim has been discussed by the learned Session Judge, but it has not been mentioned that injuries are grievous in nature. Thus submissions is that the injuries sustained by the victim are simple in nature.
5. Regards being had to the submissions made by the parties and taking into consideration the fact that both the parties are co-villagers, case and counter case is there, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur Police Station
