The petitioner is apprehending his arrest in connection with Muzaffarpur (Town) P.S.Case No.863 of 2018 dated 28.11.2018 registered for offences punishable under Section 135 of the Indian Penal Code.

Allegation is of theft of electric energy to the tune of Rs.2,66,408/-.

Submission of the learned counsel for the petitioner is that he has filed an application for final assessment of the bill under Section 126 of the Indian Electricity Act and that is still pending. The petitioner is ready to deposit 50% of the total amount within a period of one month and rest 50% he will deposit within six weeks after final assessment.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of order along with the bank draft of Rs.1,33,204/- payable in the name of North Bihar Power Distribution Company Ltd. and once the same is deposited, he will be granted provisional bail in connection with Muzaffarpur (Town) P.S.Case No.863 of 2018 dated 28.11.2018 with condition that once the final assessment is made, he will deposit rest of the amount within eight weeks from the date of final assessment. Once the total amount is deposited, his bail bond shall be confirmed.

With the aforesaid observation, this application is disposed of .
