JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2016 Heard learned counsels for the petitioner and learned APP for the State.

The petitioner, who is languishing in custody 23.11.2012, has renewed his prayer for bail in a case registered for the offences punishable under section 302 IPC in connection with Motihari Mufasil P.S. Case No.375/2012, pending before the learned Additional Sessions Judge-IVth, East Champaran, Motihari.

It is alleged that the informant being wife of the victim with her husband was assaulted by this petitioner being own brother of the victim by iron rod with regard to the partition dispute when the husband of the informant subsequently succumbed to the injuries.

The report of the learned 9th Additional Sessions Judge, East Champaran at Motihari, which received through

Patna High Court Cr.Misc. No.13005 of 2015 (4) dt.13-01-2016 2/2 letter no.253/2015, dated 11.05.2015, reflects that out of eight witnesses three have been examined and the rest is likely to be examined and the trial is likely to be concluded within a period of six months.

Considering the report of the learned trial court, this court is not inclined to grant bail to the petitioner at present. Accordingly, the application is disposed of.

It is expected from the trial court, if the trial has not been concluded, make all efforts to concluded the trial expeditiously.
