The matter is being heard through video conferencing due to circumstances prevailing on account of Covid-19 pandemic.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Gaighat P.S. Case No.120 of 2021 registered for offences under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a), 41(1) and 36 of the Bihar Prohibition and Excise Act.

One Sunil Sahni and Punita Devi have been arrested

Patna High Court CR. MISC. No.11192 of 2022(2) dt.01-04-2022 2/2 on the spot. It is stated that they have named the petitioner in their self inculpatory confessional statements. The recovery of illicit liquor is from the back side of house of accused Sunil Sahani. The petitioner has clean antecedent.

Considering the aforesaid facts, this application for anticipatory bail is allowed.

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-1, Muzaffarpur in connection with Gaighat P.S. Case No. 120 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sandeep Kumar, J) BT/- U T
