2. The petitioner seeks bail in a case registered for offence under Sections 302, 304(B), 201 and 120(B) of the Indian Penal Code.

3. As per prosecution case, the informant's daughter was married with petitioner as per Hindu rites, but just after the marriage, all accused persons subjected her to cruelty and harassment due to non-fulfillment of Rs. 5 lakhs, as additional demand of dowry, and ultimately, killed her.

4. Learned counsel for the petitioner submits that petitioner happens to be husband of the deceased and has committed no offence. In fact, petitioner and the deceased had love marriage and the relation between them was harmonious.

In this case, charge has already been framed on 26.11.2024 and during trial, the informant, who is father of the deceased, was examined as P.W.-5, and had deposed that there was no dowry demand and his daughter had died due to illness and information regarding her death has been communicated to him by this petitioner on phone. Petitioner has got clean antecedent and is in custody since 18.04.2024.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Benipur, Darbhanga in connection with Biraul P.S. Case No. 85 of 2024.
