ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in complaint case no. 3282 of 2013 Tr. No. 3716/2015 registered for offences punishable under Section 138 N.I. act and 406 of the Indian Penal Code.
Without going into the merits of this case and in view of the submission made on behalf of the petitioner that he is ready to pay the alleged amount within a period of 5 months, it is directed that the petitioner shall repay the amount of Rs. 2,51,530/- in five equal installment within a period of 5 months. In the event of first installment being paid within four weeks from
Patna High Court Cr.Misc. No.3984 of 2016 (4) dt.26-04-2016 2/2 today, and in view of the aforesaid submissions, let the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Sri Mukesh Kumar Mishra, Judicail Magistrate 1st Class, Muzaffarpur, in connection with complaint case no. 3282/2013 Tr. No. 3716/2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
