Mr.Nand Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 23-07-2025 Heard Mr. Yogesh Kumar, learned counsel appearing on behalf of the petitioner and Mr. Nand Kumar, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 46-C/2022 registered for the offence(s) punishable under Sections 323, 504 and 498(A) of the Indian Penal Code and Section 4 of DP Act.

3. The complainant, who is the wife of the petitioner has alleged that for non-fulfillment of demand of dowry, the petitioner and his family members have tortured and assaulted her and her baby female child.

4. Learned counsel appearing on behalf of the

No.11752 of 2025(3) dt.23-07-2025 2/3 petitioner submitted that due to strained matrimonial relationship between the petitioner and the opposite party no.2, who is legally wedded wife of the petitioner, the present complaint has been filed. Learned counsel further submitted that he has made specific statement in paragraph no.9 of the bail application that the petitioner is ready to keep his wife/opposite party no.2 with full dignity and honour. Learned counsel further submitted that the petitioner will also take care of his only child and in that view the petitioner deserves to be released on prearrest bail.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Though vakalatnama has been filed on behalf of the complainant but no one has appeared today on her behalf.

7. In view of the allegation made in the FIR and the petitioner's specific statement made in paragraph no.9 of the bail application that he will keep his wife/opposite party no.2 with full dignity and honour, the petitioner who is husband of the complainant is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two
