JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 30-11-2016 Petitioner's grievance is that there is encroachment on both sides of road of Paswan Chouk to Goshala Chouk Ring Bandh Roads which goes to Punauradham, Sitamarhi.
Accordingly, this writ application is being disposed of with a liberty to the petitioner to move properly before the respondent no.4, the Anchal Adhikari, Sitamarhi for removal of the encroachment. If such application is filed then Anchal Adhikari, Sitamarhi would be at liberty to examine the matter and if it is found that there is encroachment on public road or public land then he will take steps in accordance with law following the procedure laid down in the Bihar Public Land Encroachment Act, 1956 and initiate a
Patna High Court CWJC No.1602 of 2016 dt.30-11-2016 2 / 2 proceeding and bring the same to its logical conclusion within six months. However, it is made clear that nothing should be done by him without granting reasonable and adequate opportunity to all the concerned persons including the alleged encroachers, if any.
