JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 Petitioner seeks bail in connection with Rajapakar P.S. Case No. 199 of 2019, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.
Allegation is of recovery of two cartridges from the petitioner and petitioner was arrested there while petitioner and others were preparing to commit dacoity and he is accused in several other cases.
Submission of learned counsel for the petitioner is that he is in custody for about six months and co-accused has been granted bail by a co-ordinate Bench of this Court by order dated 24.1.2019 passed in Cr.Misc.No. 86452 of 2019. Heard learned APP also.
In view of above facts and circumstances, let
Patna High Court CR. MISC. No.8599 of 2020(2) dt.27-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Rajapakar P.S. Case No. 199 of 2019 on the condition that he has to appear before police station of his local area in second week of every months for a period of nine months, so that police may watch his activities and if his active involvement is found in future in such type of case, prosecution is at liberty to move for cancellation of his bail bonds.
