JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-04-2017 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Niyamchandpur P.S. Case No. 11 of 2016 registered for the offences punishable under Sections 302, 341, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, the son of the informant was got killed wherein, the driver of the informant had given tip-off of whereabouts of his son to the petitioner and others who were on inimical terms with the informant's son who had killed his son. Submission is of false implication and that besides suspicion, there is nothing against the petitioner. During investigation also nothing has come. All the witnesses have raised

Patna High Court Cr.Misc. No.12758 of 2017 (2) dt.13-04-2017 2/3 suspicion against the petitioner also. The petitioner is lady and she is suffering in custody since 25.10.2016. Chargesheet has already been submitted and there is no chance of tampering with the prosecution evidence. Other co-accused, namely, Bauaa Paswan who is the driver of the vehicle and Ghanshyam Paswan have already been allowed bail by different co-ordinate Benches of this Court and, as such, the petitioner also deserves sympathetic consideration.

The learned A.P.P. fairly submits that two co-accused persons have been allowed.

In the facts and circumstances stated above, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session's Judge-IV, Begusarai in connection with Session's Trial No. 744 of 2016 arising out of Niyamchandpura P.S. Case No. 11 of 2016 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on her part without any reason shall disentitle the petitioner from
