The petitioner seeks bail in Daudnagar P.S. Case No. 311 of 2017, instituted for the offence under Section(s) 392 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of incriminating article from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Hemant Kumar who has already been granted bail by coordinate Bench of this Court vide order dated 26.3.2018 passed in Cr. Misc. 17015 of 2018.

Petitioner is in custody since 20.10.2018 having clean

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, in connection with Daudnagar P.S. Case No. 311 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
