The petitioner seeks bail in Bihpur P.S. Case No. 520 of 2020, registered for the offence punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.

As per the prosecution case, informant suspects that this petitioner along with co-accused person committed murder of the brother of informant (deceased). Alleged incident took place due to illicit relation of this petitioner with the wife of deceased.

It is submitted on behalf of the petitioner that there is no eye-witness of the occurrence. Nobody has claimed to have seen the occurrence. Suspicion has been raised against this petitioner because of his so-called illicit relation with the wife of deceased. Petitioner claims clean antecedent and he is in

Patna High Court CR. MISC. No.10761 of 2022(2) dt.26-04-2022 2/2 custody since 09.03.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge, Naugachia, Bhagalpur in connection with Bihpur P.S.
