A counter affidavit on behalf of the respondent nos. 2 and 3 is filed.
In substance, the grievance of the petitioner(s) is that although their names found mentioned in the recommendation or the list prepared by the District Magistrate Khagaria for grant of pension under J.P. Senanee Yojna formulated by the State Government, the respondents have not till date consider their claim for grant of pension under the said yojna. It is stated that
Patna High Court CWJC No.6495 of 2014 (2) dt.06-10-2016 2/2 some other recommendee(s) like the petitioner(s) had filed a writ petition which was disposed of by directing the petitioners to file a fresh application before the concerned authority who shall consider their claim in accordance with law.
In the counter affidavit filed on behalf of the District Administration, it is stated that their names were sent to the Government for consideration by the District Magistrate. The matter is pending at the level of the Advisory Council constituted by the Government for the said purpose.
After hearing both sides and on perusal of materials on records, in my opinion, the ends of justice shall be served if the petitioners are granted a liberty to file a representation/application before the concerned authority of the State ventilating their grievance as raised in this writ application. Needless to observe, if any such application/representation is filed within four weeks, the same shall receive due consideration and disposal at the hands of the concerned authority/respondents in accordance with law as quickly as possible.
The writ application stands disposed of.
