This application, for grant of anticipatory bail, arises out of Special Case No. 91 of 2020, arising out of Athmal Gola Police Station Case No. 142 of 2020, disclosing offences under Sections 22(C)/27(A) of the N.D.P.S. Act. As per allegation, the police got an information that the present petitioner along with other co-accused are indulged in smuggling of Ganja. A total quantity of 25.590 kg. of Ganja was recovered from the Bhusa house of the present petitioner and similarly huge quantity of Ganja was also recovered from the houses and vehicle of the other accused persons.

Patna High Court CR. MISC. No.22271 of 2021(2) dt.25-01-2022 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicted in this case and the house from where the Ganja was recovered, is joint family property.

The FIR shows itself that the police got information that petitioner, Sanjay Rai, was indulged in illegal business of Ganja and huge Ganja was recovered from his house, as such, it is not a fit case for anticipatory bail, accordingly, it is rejected. (Nawneet Kumar Pandey , J) sanjeev/- U T
