JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-11-2019 Petitioner in the present case is challenging the grant of license of Public Distribution System Shop to the private respondent nos. 11 and 12. He is also aggrieved by ignorance of his candidature for the grant of license.
No one appears on behalf of the petitioner.
Learned counsel for the State is present and submits that the petitioner seems to have submitted an objection to the merit list
Patna High Court CWJC No.5334 of 2019(2) dt.07-11-2019 2/2 vide his notice dated 22.09.2018 as contained in Annexure '5' to the writ application. It is submitted that he also seems to have been pursuing the matter with the District Magistrate who is the appellate authority in terms of Rule 32 of the Bihar Targeted P.D.S. (Control) Order, 2016 (hereinafter referred to as the 'Control Order, 2016'), therefore, a direction may be issued to the District Magistrate, Buxar (Respondent No. 4) to look into the grievance of the petitioner and take an appropriate view of the matter after hearing all the stock holders.
In the given facts and circumstances of the case, this writ application is being disposed off with a direction to the District Magistrate, Buxar (Respondent No. 4) to look into Annexure '5' and the subsequent representation of the petitioner which is part of this writ application treating them as an appeal of the petitioner in terms of Rule 32 of the Control Order, 2016, examine the same and pass an appropriate order after hearing the petitioner as well as private respondent nos. 11 and 12.
