The petitioner seeks bail in Ratanpura P.S. case No. 09 of 2017 under Section 38(a)/ 41 (a) (2) of the Bihar Prohibition & Excise (Amendment) Act, 2016.

The petitioner is the driver of the vehicle and from the vehicle 172 liquor Nepali liquor was recovered but for that petitioner is in jail since 06.02.2017. The petitioner has remained in jail for more than three months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Birpur (Supaul) in Ratanpura P.S. Case No. 09 of 2017.
