JUSTICE VIKASH JAIN ORAL ORDER 11-04-2017 Learned counsel for the petitioner seeks permission to make necessary corrections in paragraph 8 of the petition substituting the word "owner" with the word "driver". 2.
Permission is accorded to make necessary corrections in course of the day.
3. Heard learned counsel for the petitioner and learned APP for the State.
4. The petitioner is in custody since 08.02.2017 in connection with Barauli P.S. Case No. 17 of 2017 for the offences alleged under Sections 272, 273 and 420 of the Indian Penal Code and 30(A) (B)(C) of the Bihar Excise (Amendment) Act, 2016.
5. It is submitted that the petitioner has been falsely implicated in connection with the alleged recovery of 34 litres of illicit foreign liquor. Recovery of the offending goods from the possession of the petitioner is denied. The petitioner claims clean antecedents.
6. Be that as it may, having regard to the entirety of the facts and circumstances of the case as well as the period of custody since 08.02.2017 already suffered, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten
Patna High Court Cr.Misc. No.17812 of 2017 (2) dt.11-04-2017 2/2 thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S. Case No. 17 of 2017.
