This appeal is directed against the order dated 26.11.2019 passed by 1st Additional Sessions Judge-cumSpecial Judge, Hajipur, Vaishali in Patepur P.S. Case No. 161 of 2018 registered under sections 341, 323, 379, 376/34 of the Indian Penal Code and Sections 4/6 of the POCSO Act and section 3(i)(e)/3(2)(v) of the SC/ST (Prevention of Atrocities) Act.
Learned counsel appearing for the appellant submits that the appellant is innocent and he has been falsely implicated in this case due to admitted land dispute between the parties. As a matter of the prosecution side is in
Patna High Court CR. APP (SJ) No.581 of 2020(3) dt.01-06-2020 2/2 habit of launching false cases with intention of extorting money. Appellant is a man of clean antecedent and is in custody since 01.07.2019.
Learned Special P.P. appearing for the State submits that the allegations levelled are specific against this appellant. Medical evidence supports the allegations levelled and further the witnesses have also supported the prosecution case.
Considering the facts and circumstances of the case, the submissions advanced on behalf of the parties and the nature of allegations levelled, this Court is not inclined to grant bail to the appellant. His prayer for bail is, accordingly, rejected.
The appeal, thus, stands dismissed.
