JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and Mr. Sanjay Kumar Sharma, learned A.P.P. for the State. The petitioner seeks bail in connection with Khizarsari P.S. Case No. 385 of 2021 instituted for the offences under Sections 30(a), of the Bihar Prohibition & Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 06.12.2021 is a person of clean antecedent charge-sheet has been submitted in the case and allegation is of recovery of 1016.6 liters of liquor from a truck. Learned counsel for the petitioner submits that the petitioner is the driver of the truck and as such was not knowing what was kept in the truck by the owner and the transporter.

Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.11227 of 2022(2) dt.11-03-2022 2/2 prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 06.12.2021, charge-sheet has been submitted and is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Gaya in connection with Khizarsarai P.S.
