None appears on behalf of opposite party no. 2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 53 of 2017 for the offences alleged under Sections 323, 379, 498A and 504 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.

The accusation is of torturing of complainant/opposite party no. 2 by her husband and in-laws due to non-fulfillment of demand of dowry and removing her from matrimonial house. Learned counsel appearing for the petitioner submits that on the joint prayer of petitioner and complainant/opposite

No.11454 of 2019(4) dt.21-08-2019 2/2 party no. 2 the matter was referred before the Mediation Center, Patna High Court, for settlement of dispute, where, both, petitioner and complainant/opposite party no. 2, accepted about performing of their re-marriage, which would appear from the report of Mediator, dated 07.08.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Complaint Case No. 53 of 2017 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Nawada, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
