The petitioner is in custody in connection with Special Case No. 19 of 2019, arising out of Bhagwanganj P.S. Case No. 175 of 2018 for the offence under Sections 30(a), (c) (d), 37 (b)of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case 100 liters Mahua wine was seized. Learned counsel for the petitioner further submits that nothing was recovered from the conscious possession of the petitioner. He submits that petitioner is in custody since 01.01.2019.

Considering the fact that the petitioner has no criminal antecedent, let the petitioner named above, be released on bail

No.11586 of 2019(2) dt.26-02-2019 2/2 on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special case No. 19 of 2019, arising out of Bhagwanganj P.S. Case No. 175 of 2018.
