The petitioner apprehends his arrest in connection with Complaint Case No. 948 of 2015 registered under Sections 147, 323, 341, 504, 498(A), 420, 379, 12(B) and 34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that complainant(O.P.-2) left her matrimonial house herself and thereafter several efforts has been taken by the petitioner to bring her back but she did not return, then he filed an
Patna High Court CR. MISC. No.22137 of 2021(2) dt.28-01-2022 2/2 informatory petition, as contained in Annexure-3 to the bail application. Further he submits that learned Principal Judge, Family Court, Madhepura after hearing the parties and after going through the material available on record, decreed the Matrimonial Suit. Even thereafter complainant did not obey the judgment of the learned Court below, as contained in Annexure-4 to the bail application. Petitioner has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Complaint Case No. 948 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
