The order of cancellation of licence of the petitioner was appealed against but on grounds of limitation of about thirty days, the appeal has been dismissed.
We find that the petitioner deserves to be heard in appeal.
Patna High Court CWJC No.3187 of 2022(2) dt.09-03-2022 2/2 While saying so, we have taken note of the fact that the petitioner had sufficient reasons for preferring the appeal beyond the period of limitation.
We, therefore, set aside the order dated 19.02.2021, passed in P.D.S. Appeal Case No.01/21, and remit the case to the appellate authority to give a hearing to the petitioner and pass a final order in appeal within a period of sixty days from the date of receipt/production of a copy of this order.
The order so passed by the appellate authority shall provide reasons for his conclusions.
The petition stands disposed of accordingly.
