JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Laukahi P.S. Case No. 191 of 2018, G.R. No. 1438 of 2018 for the offenses under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner would submit that allegation against the petitioner is that he along with others assembled to commit serious crime. From the possession of the petitioner a double barrel gun with five live cartridges were seized. The petitioner is in custody since 28.10.2018.
