The petitioners apprehend their arrest in Kursela P.S. Case No. 151 of 2016 instituted for the offence under Sections 302, 384, 504, 506/34 of the Indian Penal Code, Sections 25(1-b)a and 27 of the Arms Act.

It has been submitted that the petitioners are ladies. There is general and omnibus allegation against them. In the written report there is specific allegation against Nepali Mandal who fired upon the husband of the informant due to which he fell down. Thereafter, on hulla villagers arrived there and the husband of the informant was taken to the hospital, but he died.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Kursela P.S. Case No. 151 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Katihar, subject to the conditions as laid down under Section 438 (2) Cr.
