ANJANA MISHRA ORAL ORDER 05-08-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 17.11.2018 on his surrender in connection with Warsaliganj P.S. Case No.192 of 2018 registered for the offence under Section 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner of assaulting and strangulating the deceased along with other persons who were alleged to be present at the place of occurrence. Learned counsel for the petitioner further submits that there is no specific allegation against the present petitioner and at best, he can be treated as a member of the
Patna High Court CR. MISC. No.21997 of 2019(4) dt.05-08-2019 2/2 crowd.
Considering the aforementioned facts and circumstances and this Court, while rejecting the prayer for anticipatory bail in Cr.Misc. No.51895 of 2018 vide order 29.10.2018, had directed that if the petitioner surrenders before the court below, his case may be considered on its own merit and also because he has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Nawada, in connection with Warsaliganj P.S. Case No.192 of 2018.
