Case No. 45 of 2017, disclosing offences under Sections 30(a) of the Bihar Prohibition of Excise Act, 2016. Allegation against the petitioner and several other accused persons is of manufacturing the illicit liquor and on information police raided the place and recovered 25 litres of mahua liquor and petitioner succeeded in fleeing away Submission of learned counsel for the petitioner is that he has falsely been made accused in this case and has no criminal antecedent and name of the petitioner surfaced in this

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna, in connection with Special Case No. 45 of 2017 arising out of Masaurhi P.S. Case No. 45 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
