JUSTICE SHIVAJI PANDEY ORAL ORDER 13-10-2020 Heard learned counsel for the petitioner and learned APP for the State through Virtual Court Proceeding. In this case, the petitioner is seeking regular bail in connection with Dumra P.S. Case No. 92 of 2019, registered for the offence under Sections 304(B)/34 of the Indian Penal Code and under Section 3 / 4 of the Dowry Prohibition Act. As per the F.I.R., the daughter of the informant was married with the petitioner in the year 2018. After the marriage the petitioner and his family members used to demand one motorcycle from his daughter and on account of non-fulfillment of demand, she has been killed by the accused persons. In different paragraphs of the case diary, statement has come that accused persons used to demand motorcycle from the daughter of the informant and on account of non-fulfillment
Patna High Court CR. MISC. No.11279 of 2020(8) dt.13-10-2020 2/2 of said demand, she has been killed. The postmortem report suggest that the deceased died of unnatural death due to constriction in the windpipe.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to expedite the trial and conclude the same within a period of one year after restoration of normal Court proceeding. (Shivaji Pandey, J) pawan/- U T
