This is a petition for grant of regular bail in a case under Sections-302, 201 and 34 of the Indian Penal Code. It is alleged that the husband of the informant was taken away to the hospital on a Belero by the petitioner and his wife and since then the husband of the informant is traceless. It is submitted by the learned counsel for the petitioner that it has come in the case diary that the dead body was recovered on 03.04.2014, but it was only the skeleton and it was claimed that it is the skeleton of husband of the informant. The confessional statement of Mantu Rai also indicates only suspicion. However, from the entire evidence, except suspicion there is nothing against the petitioner in the case diary.
Patna High Court Cr.Misc. No.53668 of 2015 (3) dt.11-02-2016 Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Derni P.S. Case No. 28 of 2014.
