JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-02-2016 The present application has been filed for modification of order dated 14.08.2012 passed in Cr. Misc. No. 28788 of 2012 for extending the period of surrender. It is submitted by learned counsel for the petitioner that the petitioner could not surrender due to the fact that he met with serious accident.

This Court is not inclined to modify the order after more than three years of the passing of the order. The order dated 14.08.2012 passed in Cr.

Misc. No. 28788 of 2012 is hereby rescinded.

Considering the fact that the petitioner was granted anticipatory bail on merits, it is expected from the learned court below to pass appropriate order with regard to regular bail

Patna High Court Cr.Misc. No.4304 of 2016 (2) dt.10-02-2016 2/2 of the petitioner, preferably on the same day, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Lakhisarai (Kabaiya) P.S. Case No. 254 of 2011 pending in the court of learned Chief Judicial Magistrate, Lakhisarai.

Accordingly, this modification application is disposed of.
