====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-12-2021 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 365 of the Indian Penal Code.

It is a case of abduction of the daughter of the informant. The victim girl in her 164 Cr.P.C statement

Patna High Court CR. MISC. No.21000 of 2021(2) dt.21-12-2021 2/3 has stated that she of her own goodwill left the house and went with the petitioner to Patna and thereafter to Mumbai. She also stated that this petitioner established physical relationship with her. She also alleged that parents of the petitioner demanded rupees five lakhs as dowry for marriage of the victim girl with the petitioner. It is submitted by learned counsel for the petitioner that the victim has recorded her age as 18 years. The petitioner and the victim girl were in love with each other and they wanted to marry which was not acceptable to the family members of the victim girl. Hence, against the will of the family, they married on 06.07.2020 and thereafter went to Mumbai. It is further submitted that both the petitioner and the victim girl have consensual relationship and the petitioner has not committed any wrong. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let

No.21000 of 2021(2) dt.21-12-2021 3/3 the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, II, Munger in connection with Bariyarpur P.S. Case No. 59 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
