The petitioner is accused in connection with Jakkanpur P.S. Case No. 614 of 2019 registered under sections 8C/21(c)/25/29 of the N.D.P.S. Act pending in the Court of Sessions Judge/Spl. Judge, N.D.P.S. Act, Patna. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has no criminal antecedent and he is in custody since 16.09.2019. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner was caught red handed while packing the brown

Patna High Court CR. MISC. No.12272 of 2020(2) dt.29-02-2020 2/2 sugar. Hence, he does not deserve the privilege of bail. Having considered the above facts and circumstances of the case, this Court is not inclined to allow the prayer of the petitioner for bail. Accordingly, prayer for grant of regular bail of the petitioner is rejected.

However, liberty is granted to the petitioner to renew his prayer for bail after framing of charge.
