1. Though the present writ petition has been filed to restrain the respondents from constructing school building over the land of the respondent no.14, situated at Mauza-Ekamba, Block- Chhourahi, Thana No.116, appertaining to Khesra

Patna High Court CWJC No.2366 of 2024(4) dt.03-12-2024 2/2 No.865, admeasuring 3 katha, which is not sufficient for construction of a school building, however, at the outset, the learned counsel for the respondent State has submitted by referring to the letter dated 11.03.2024, written by the District Magistrate, Begusarai to the District Education Officer, Begusarai, annexed as Annexure-E to the counter affidavit filed by the respondent State that the District Education Officer, Begusarai, has been requested to take the final decision in the matter, after considering the inquiry report submitted by the Sub Divisional Officer, Manjhaul, District-Begusarai.

2. At this juncture, the learned counsel for the petitioner seeks a direction upon the District Education Officer, Begusarai to take the final decision in the matter.

3. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the District Education Officer, Begusarai to take a final decision in the matter, as aforesaid, within a period of four weeks of receipt/production of a copy of this order.

4. The writ petition stands disposed off on the aforesaid terms.
