Petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code and 27 of Arms Act and 15,16,18,20 of the Unlawful Activities Prevention Act.

The FIR of the occurrence of murder is against unknown. Only material against the petitioner is confessional statement before the police while in police custody. Co-accusedArvind Kumar @Arvind Yadav @ Arvind Kumar Yadav has already been allowed bail by a Coordinate Bench of this Court vide order at Annexure-2. There is no material to substantiate that petitioner is going to tamper with the evidence or hamper the trial.

No.12047 of 2020(2) dt.29-02-2020 2/2 Learned counsel for the informant opposed the prayer for bail on the ground that the petitioner is king-pin of the whole occurrence and a gang created by the petitioner is running in the locality. He further submitted that trial is already at the verge of conclusion.

Considering the fact that in the present case there is no direct material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.222 of 2019 arising out of Govindpur Police Station Case No.21 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
