JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2017 The petitioner is in custody since 17.12.2016 in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 275 of 2016, registered for offences punishable under Sections 302, 201, and 120(B) Indian Penal Code.
It has been submitted on behalf of the petitioner petitioner's name has surfaced in this case only on the basis of confessional statement of co-accused before the police and except that there is nothing against the petitioner and he has been in custody since 17.12.2016.
Heard learned A.P.P. also.
Having heard both sides, no doubt in this case petitioner's name has come on the basis of confessional statement of co-accused, however, considering the nature of allegation and
Patna High Court Cr.Misc. No.6907 of 2017 (3) dt.28-03-2017 2/2 also petitioner has criminal antecedent as he is an accused in three other cases, as such, at present, I am not inclined to grant the petitioner the privilege of regular bail, it is accordingly rejected. However, the petitioner may renew his prayer for bail, in the court below itself once charges are framed in this case. (Vinod Kumar Sinha, J) sunil/- U T
