The petitioner apprehends his arrest in connection with Ramgarh P.S. Case No. 308 of 2018, registered under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

The accusation is that at about 6 P.M. on 28.11.2018, informant along with Pankaj Singh and Deepak were sitting near mill. In the meantime, Ranjit Yadav (petitioner), Upendra Yadav, Nandlal Yadav and Tejdhari Yadav having gun and country made pistol in their hand reached there and started to abuse. At that time, petitioner gave butt blow causing injury at the back of the head of the informant, in

Patna High Court CR. MISC. No.10559 of 2019(3) dt.14-05-2019 2/2 which, he fell down and thereafter all tried to load him in vehicle. In the meantime, petitioner and Upendra Yadav gave knife blow to the informant with intention to kill him. On raising alarm, villagers rushed there then all fled away. Learned counsel for the petitioner submits that petitioner and the informant are co-villagers and due to dirty village politics, the present case has been lodged with false allegation. Moreover, the injuries, as found on the person of the informant, are simple in nature and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-I, Kaimur at Bhabua, in connection with Ramgarh P.S. Case No. 308 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
