JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Beldore P.S. Case No. 15 of 2015, registered under Section 377 of the Indian Penal Code and Section 3/4 of POCSO Act. The accusation is of committing unnatural offence with Nishant Kumar, aged about 03 years, son of the informant by this petitioner.

Learned counsel appearing on behalf of the petitioner submits that victim was examined on the same day, but the opinion of Doctor is that he could not in a position to say, whether unnatural offence has been committed or not. Further submission is that, in fact, the petitioner is co-villager of the

Patna High Court Cr.Misc. No.1710 of 2016 (3) dt.23-02-2016 2/2 informant and due to grudge and enmity he has falsely been implicated in this case. The petitioner is in custody since 05.06.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional and Sessions Judge 1st Class, Khagaria in connection with Beldaur P.S.
