Petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
The FIR of theft is against unknown.
Submission of the petitioner is that nothing has been recovered from the possession of the petitioner and his name transpired in the confessional statement of the co-accused. The supplementary affidavit filed by the petitioner reveals that the petitioner is named in only one and in other cases he has been named during investigation while the FIRs were against unknown.
Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.9110 of 2017 (3) dt.21-03-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 9th Additional Chief Judicial Magistrate, Motihari, East Champaran/successor Court in connection with Kalyanpur Police Station Case No. 132 of 2016, subject to the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
