JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 329(C) of 2017, lodged for the offences punishable under Sections 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Allegation against the petitioner is of subjecting opposite party No.2-wife to cruelty with respect to demand of dowry. Submission of learned counsel for the petitioner is that the divorce case filed by opposite party No.2 before the Family Court, Dhanbad has been transferred to Patna at her instance and in spite of that she is not appearing in the matter which is pending for reconciliation.

Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Danapur, Patna, in connection with Complaint Case No. 329(C) of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that he has to appear in divorce case and at the same time opposite party No.2 is also directed to appear in the divorce case for reconciliation and both the parties shall abide by the result of reconciliation.

With the above observation, this application is disposed of.
