The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 323, 307, 379, 504, 506/34 of the Indian Penal Code. Prosecution case is that the accused persons hold the informant hostage for half an hour and continued abusing him. The specific accusation is that co-accused Bipin Kumar Sah assaulted on the head of the informant when petitioner no.1, Janardan Sah snatched Rs.25,000/- and petitioner no.2, Manjay Kumar snatched gold chain and silver braslet. It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.6484 of 2016 (2) dt.11-02-2016 2/2 that for the occurrence of 16.09.2015, the F.I.R. was lodged on 3.10.2015. The co-accused Bipin Kumar lodged Complaint Case No.3390 of 2015 with accusation under Sections 323, 452, 380, 384, 386, 392, 307, 506, 34 and 120B of the Indian Penal Code against the informant and others. There is specific accusation of assault against co-accused Bipin Kumar.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Mithilesh Kumar, J.M., 1st Class, Purnea in connection with Bhawanipur P.S. Case No.215 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
