The petitioner has preferred this application for grant of regular bail in a case registered under sections 8, 20(b)(ii)(c) and 25 of the N.D.P.S. Act.

As per the prosecution case, about 205 kgs of ganja was recovered from the Maruti Suzuki Swift vehicle bearing registration no.AS 01AT-2321 and the petitioner was also stated to be in the said vehicle.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He has no concerned either with the vehicle in question nor with the seized contraband. The petitioner was apprehended under a

Patna High Court CR. MISC. No.22134 of 2021(2) dt.07-10-2021 2/2 misunderstanding. He has no criminal antecedent and is in custody since 21.12.2018.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the submissions made on behalf of the petitioner together with the petitioner having remained in custody for more than 2 years 9 months, the Court directs the petitioner to be enlarged on bail in connection with Spl. Case no.22 of 2018/CIS no.22 of 2018(NDPS Act), arising out of Dagarua P.S. Case no.261 of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S. Act, Purnea.
