Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with K.Hat (Maranga) P.S. Case No. 1057 of 2021, registered for offence punishable under section 376 (D) of the Indian Penal Code and Section 4/6 POCSO Act 2012.

As per allegation, the petitioner had physical relation with the informant. When the parents of the informant asked the petitioner to solemnize marriage with the victim, his father demanded Rs. 3,00,000/- as dowry and only after payment of that dowry he has assured that the marriage would be solemnized.

Patna High Court CR. MISC. No.11722 of 2022(2) dt.17-09-2022 2/2 The learned counsel for the petitioner has submitted that both the parties have compromised. The petitioner has solemnized the marriage with the informant and the couple are living happily and cordially.

On the other hand, Mr. Yogendra Kumar Singh, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS) Act, Purnea in connection with K.Hat (Maranga) P.S. Case No. 1057 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
