The petitioner seeks bail in Mairwa P.S. Case No. 46/2012, registered for the offences punishable under Section 406 of the Indian Penal Code.

The informant alleged that at the request of the petitioner he handed over the motorcycle bearing registration no. UP57J6275, but the petitioner did not return his motorcycle. It is submitted that the petitioner never took the motorcycle of the informant. There is nothing on record to show that the petitioner committed any criminal breach of trust. The petitioner is in jail since 20.01.2017.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that the petitioner is in jail

Patna High Court Cr.Misc. No.14059 of 2017 (2) dt.11-04-2017 for about two and half months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Mairwa P.S.
