This application is for grant of bail in connection with Roshanganj P.S.Case No.81 of 2014 for the offence under Sections 147, 149, 148, 120(B), 121(A), 122, 124(A), 323, 325, 427, 385, 386 & 395 of the Indian Penal Code, 3⁄4 of Explosive Act and 12, 16, 18 and 20 of the U.A.P. Act and 17 of C.L.A. Act. According to the petitioner, nothing has been recovered. It is said that in the torch light, the informant identified the petitioner among 17 other persons and the petitioner is in custody since 14.09.2016.
Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioner, stating that he is named in the F.I.R. Further it has been stated that he is accused in six other cases also and all
Patna High Court Cr.Misc. No.14008 of 2017 (2) dt.27-03-2017 2/2 cases have been registered under C.L.A. Act, Section 27 of the Arms Act and various other Sections of the Indian Penal Code. Having heard both sides and in view of the fact that the petitioner is named in the F.I.R. as well as the fact that he has criminal antecedent, I am not inclined to grant bail to the petitioner, however, the petitioner is in custody for about six months, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible.
With the aforesaid observation, this application is dismissed.
