The petitioners seek bail in connection with Jandaha P.S. Case No. 298 of 2021 instituted for the offences under Sections 414, 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition & Excise Act. Learned counsel for the petitioners submits that petitioners are in custody since 19.12.2021, are persons with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 1000 liters of liquor from Tata Sumo.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.11223 of 2022(2) dt.11-03-2022 2/2 petitioners are neither the owner nor the driver of the vehicle and he had merely taken lift and came to be implicated when the search was made.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioners are in custody since 19.12.2021, charge-sheet has been submitted in the case and are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Spl. Excise Court No. 1 cum Additional District & Sesssions Judge, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 298 of 2021.
