JUSTICE BIRENDRA KUMAR ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 399/402/120B/34 of the Indian Penal Code and Sections 20(b)/22 of the N.D.P.S. Act. The F.I.R. would reveal that seven persons including the petitioner were apprehended by the police. However, nothing was recovered from the possession of the petitioner.

Submission is that similarly situated co-accused Aditya Kumar has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.2082 of 2017 on 23.01.2017.
