The petitioner seeks bail in Raxaul P.S. Case No. 293 of 2016 registered under Sections 461 and 379 of the Indian Penal Code.
The petitioner is not named in the F.I.R. The police arrested the petitioner and the petitioner has confessed his guilt and after confession of the petitioner, stolen articles were recovered from the house of Rahul Das, Ashish Kumar Mishra and others.
Leanred counsel for the petitioner submits that the petitioner is in jail since 17.12.2016 and nothing has been recovered from the possession of the petitioner. He was keeping watch on the house in which theft was committed. Considering the facts aforesaid and the petitioner
Patna High Court Cr.Misc. No.19180 of 2017 (2) dt.28-04-2017 2/2 has already remained in jail for four months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran in connection with Raxaul P.S.
