The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 457.92 litres of IMFL was recovered from brick kiln and the owner and the clerk (petitioner ) of the said brick kiln were made accused. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered as alleged in the FIR. The owner of the brick kiln has been enlarged on anticipatory bail vide order dated 27.11.2019 (Annxure-2)

Patna High Court CR. MISC. No.11779 of 2022(2) dt.15-04-2022 2/2 passed in Cr. Misc. no. 65778 of 2019. The petitioner is in custody since 19.1.2022 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Uchkagaon P.S. Case no. 170 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II - cum - Special Judge, Excise, Gopalganj.
